This challenge was separate from Eastman’s largely unsuccessful attempt to block a House summons for communications on his working email account until around 6 January.
Eastman told the court Tuesday night that he withdrew the challenge for the phone records because Parliament was not seeking the communication itself.

The limited nature of the House’s selection committee requirements from telephone companies such as Verizon has been clear for months.
Eastman, however, was among dozens of people linked to former President Donald Trump and other conservative politicians who went to court to prevent phone records from becoming part of the January 6 Capitol investigation.
Verizon and AT&T said they were complying with requests to the court not to hand over the information to the House selection committee until the judges have weighed in. The cases have progressed slowly and have not yet been resolved.
Eastman had some important weeks. After losing a major legal effort to prevent the House Select Committee from receiving his emails as he tried to persuade the states to try to reverse Trump’s defeat in the 2020 election, he became a key target of the House’s public hearings and condemnation.
Separately, federal law enforcement officers searched Eastman in New Mexico last week as part of a criminal investigation and confiscated his cell phone, Eastman revealed this week. It is not clear whether he may be the target of an investigation or a witness. He has not been charged with any crime.
